Fiduciary Duties for Insurance and Employee Plan Service Providers

Andrew Ky Haynes, Esq. is back by popular demand to provide insight on a compelling issue facing us all. He will provide an in-depth discussion of the fiduciary responsibilities and evolving legal obligations of insurance professionals, third-party administrators, consultants, brokers, pharmacy benefit managers (PBMs), and other employee benefit plan service providers. This session will examine when a service provider assumes fiduciary status under ERISA, the legal risks associated with fiduciary decision-making, and best practices for managing fiduciary responsibilities in today's increasingly complex regulatory environment.

Andy Haynes is the President of Haynes Benefits PC, an employee benefits law firm in Kansas City. Andy is an author of two manuals published by the Employee Benefits Institute of America (“EBIA”), HIPAA Portability, Privacy and Security and Group Health Plans: Federal Mandates Other Than COBRA & HIPAA. Andy is a Fellow of the American College of Employee Benefits Counsel. Andy has thousands of hours as a lecturer with EBIA and other prominent employee benefits organizations, teaching in 10 to 15 cities each year.

Andy received his undergraduate degree from the University of Missouri-Columbia and his law degree from Emory University School of Law, where he was Research Editor of the Emory Law Journal. Andy serves on the Board of Directors of the American Jazz Museum. He is an active musician in his church band and the occasional gig.
